The processing of our clients’ personal data takes place within the European Economic Area (EEA), protected by European legislation, namely the GDPR. FROM only shares personal data with third parties when legally authorized to do so. In such cases, we implement appropriate contractual provisions and security mechanisms to guarantee data protection and compliance with confidentiality and security standards.

The sharing and/or transfer of data to countries outside the EEA occurs only when that country benefits from an adequacy decision by the European Commission or when relevant “standard contractual clauses” are applied. Such data sharing is conducted intra-group only.

FROM may also share data based on other lawful grounds, namely for compliance with court orders, within the scope of investigative processes, or whenever necessary to safeguard and protect our legal rights.

Your personal data will be retained for the period strictly necessary to fulfill the processing purposes identified in the table above. 8. What security measures do we use?

In order to protect your data across all stages of its lifecycle—from collection, storage, and processing, to erasure—FROM adopts a comprehensive set of technical and organizational measures designed to ensure information confidentiality, integrity, availability, and resilience.

In this context, the following technical measures, among others, are implemented:

  • Data encryption, both at rest and in transit, to prevent unauthorized access or interception;
  • Pseudonymization, where applicable, reducing the possibility of direct identification of data subjects;
  • Backup and recovery mechanisms, as well as security testing, ensuring continuity and data recovery in the event of an incident.

Concurrently, FROM applies strict organizational measures, including:

  • Definition of access profiles based on the principle of least privilege, ensuring that only duly authorized personnel within the scope of their duties can access information, including multi-factor authentication, periodic access reviews, and privilege segregation where applicable;
  • Implementation of internal security and data protection policies, regularly reviewed and updated;
  • Awareness and training sessions for employees, fostering a culture of data protection;
  • Adoption of control and monitoring procedures, including access logging and incident management, to ensure traceability of data processing operations.

FROM periodically evaluates the effectiveness of these measures to ensure their suitability against evolving risks, technological advancements, and applicable regulatory requirements.

9. What are your rights under the General Data Protection Regulation?

1. Right of Access

The data subject has the right to access their personal data and complementary information retained by us. For this purpose, you may submit a Data Subject Access Request through any of the contacts listed in Section 12 to access the data we hold about you.

2. Right to Rectification

The right to rectification consists of the right to request the correction of personal data concerning the data subject when it is inaccurate, incorrect, or incomplete. Upon receiving personal data, FROM conducts checks to detect errors, although it relies on the accuracy of information provided by suppliers and clients. If you consider that your data is inaccurate or incomplete, you have the right to request its update. Whenever data is proven to be incorrect, FROM will proceed with its due update. You may contact us using the Data Controller details in Section 12.

3. Right to Erasure (“Right to be Forgotten”)

As a data subject, you may request FROM to cease processing your personal data or erase it whenever there is no overriding lawful ground justifying its retention.

4. Right to Restriction of Processing and Right to Object

As a data subject, you have the right to obtain from FROM the restriction of processing. You have the right to object to the processing of your data or withdraw your consent at any time. Withdrawal of consent does not affect the lawfulness of processing based on consent prior to its withdrawal.

However, this is not an absolute right. Your data may continue to be processed if any of the following grounds apply:

  • For the establishment, exercise, or defense of legal claims;
  • For the protection of the rights of another natural or legal person;
  • For reasons of public interest.

FROM will review all restriction requests received and evaluate the applicability of these exceptions to the specific case.

Regarding direct marketing activities conducted by FROM, data subjects enjoy rights under the GDPR and Law No. 41/2004 of August 18. As such, you may object to processing for these purposes at any time or request erasure whenever retention is no longer legally required.

Processing activities and their purposes are detailed in Section 2; therefore, exercising the right to object does not automatically trigger immediate deletion of all data. FROM will conduct an individual review of each request, and if erasure is not legally feasible, the data subject will be duly informed of the rationale behind such impossibility.

5. Right to Lodge a Complaint

As a personal data subject, you have the right to lodge a complaint with the supervisory authority (Comissão Nacional de Proteção de Dados – CNPD) whenever you believe your rights as a data subject are not being respected.

As a data subject, you have the right to receive your personal data and transmit it to another Controller.

7. Right Not to be Subject to Automated Decision-Making or Profiling

As a data subject, you have the right not to be subject to any decision based solely on automated processing, including profiling.

8. Right to be Informed

Data subjects have the right to be informed about how we collect and use their personal data. This privacy policy serves this objective. As a data subject, you also have the right to be notified of a personal data breach likely to result in a high risk to your rights and freedoms.

Timeframe for exercising your rights:

FROM responds to data subject rights requests within a maximum period of 1 month, which may be extended up to 3 months in complex cases under the GDPR. The data subject will always be informed of the status of the request and any need for additional information.

What safeguards exist in the use of AI?

  • Human oversight and validation: In using AI systems, we guarantee human oversight and validation throughout the process. AI operates strictly as a support tool; no automated decisions producing legal or significant impacts on data subjects are taken without human intervention and control.
